1. Acceptance of Terms

By accessing, browsing, or using the RangeScan website and mobile application, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our services.

2. Description of Service

RangeScan is a free mobile application that provides target scoring and shooting performance analysis services. Our services include:

• Photo-based target scoring
• Group analysis and performance metrics
• Training session logging and tracking
• Optional connection with certified firearm instructors
• Progress tracking through the ShoQ® Journal

3. User Eligibility

You must be at least 18 years old to use RangeScan. By using our services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding agreements
• You comply with all applicable local, state, and federal laws regarding firearm ownership and use
• You are legally permitted to possess and use firearms in your jurisdiction

4. User Account and Registration

To access certain features of RangeScan, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your account credentials confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

5. Acceptable Use

You agree to use RangeScan only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the service for any illegal or unauthorized purpose
• Violate any applicable local, state, national, or international law
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the service or servers
• Impersonate any person or entity

6. Firearm Safety and Responsibility

RangeScan is a tool for scoring and analysis only. You acknowledge and agree that:

• You are solely responsible for the safe handling and use of firearms
• RangeScan does not provide firearm training or safety instruction
• You must follow all applicable firearm safety rules and range regulations
• You must comply with all local, state, and federal laws regarding firearms
• RangeScan is not liable for any injuries, damages, or incidents related to firearm use

7. Intellectual Property Rights

All content, features, and functionality of RangeScan, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of Pulse Frontier, Inc. and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or reproduce any part of the service
• Reverse engineer or attempt to extract source code
• Remove or alter any copyright, trademark, or proprietary notices
• Use our trademarks or branding without written permission

8. User-Generated Content

When you upload photos, create training logs, or submit content to RangeScan, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display such content for the purpose of providing our services.

You represent that:

• You own or have the right to use the content you submit
• Your content does not violate any third-party rights
• Your content complies with applicable laws and these Terms

9. Service Availability and Modifications

We strive to provide uninterrupted service, but we do not guarantee that:

• The service will be available at all times or without interruption
• The service will be error-free or secure
• Results or information will be accurate or reliable

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice.

10. Third-Party Services and Links

RangeScan may contain links to third-party websites or services, including instructor profiles and external resources. We are not responsible for the content, privacy practices, or terms of service of any third-party sites. Your use of third-party services is at your own risk.

11. Disclaimer of Warranties

RangeScan is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of results

We do not warrant that the service will meet your requirements or expectations.

12. Limitation of Liability

To the maximum extent permitted by law, Pulse Frontier, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of data or content
• Personal injury or property damage
• Business interruption

Our total liability shall not exceed $100 or the amount you paid us in the past 12 months, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pulse Frontier, Inc. and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any rights of third parties
• Your use or misuse of firearms

14. Termination

We reserve the right to terminate or suspend your account and access to the service at our sole discretion, without notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Prolonged inactivity

Upon termination, your right to use the service will immediately cease.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the service shall be resolved through:

• Good faith negotiations between the parties
• If negotiations fail, binding arbitration in Manatee County, Florida
• The prevailing party shall be entitled to recover reasonable attorney's fees

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Posting the updated Terms on our website
• Updating the "Last Updated" date
• Sending notice via email or in-app notification (for significant changes)

Your continued use of the service after changes constitute acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Pulse Frontier, Inc. regarding the use of RangeScan and supersede any prior agreements.
